In the spin-off agreement of summer 2001, Sulzer Medica Ltd contractually undertook to indemnify Sulzer Ltd against all expenses and damage claims arising in connection with the medical devices sector. Over the last few weeks Sulzer Medica has not only repeatedly denied any obligation to indemnify, but also acted contrary to the same.

Sulzer insists that Sulzer Medica abides by the agreement. The object of initiating these arbitration proceedings is to ensure that Sulzer Medica Ltd complies with its contractual obligations toward Sulzer Ltd.
